General Business Conditions:
- Delivery always under property retention.
- The offers are not-binding.
- Mistake and delivery opportunity reserve.
- Complaints / exchange: If the commodity is at the time of the delivery (1st) directly to the buyer or (2nd) to the mail-order house (post office, carrier, etc. / corresponds the “sending debt” after German law “BGB”) is not corresponding to the assured characteristics, exists a right to exchange from 14 days after receipt. If the exchange is not possible (e. g. because no more further pieces are available or it’s an individual offer), the back settlement of the contract or a reduction of the purchase price can be arranged.
- If not specifically indicated the respectively valid legal German Value Added Tax (VAT) is included in the prices.
- Place of delivery and area of jurisdiction are Heidelberg, Germany, as far as no other legal regulations are existing.
RIGHT OF REVOCATION for private buyers (consumers):
You can revoke your contract explanation within 14 days without information of reasons in text form (e.g., letter, fax, eMail) or by return of the article. The period begins at the earliest with receipt of this instruction. For the protection of the revocation time period, the timely sending off of the revocation or the article suffices. The revocation is to be directed to the address standing down.
CANCELLATION CONSEQUENCE for private buyers (consumers):
In case of an effective revocation, the on both sides received achievements are to return and if necessary pulled uses are to be refunded (e.g. interest). If you cannot return the received achievement to us totally or partly or only in worsened condition, you must carry out for us indemnification according to value if necessary. During the leaving of articles this does not apply, if the deterioration of the article is to be led back exclusively on its examination - as it would have been possible for instance in a retail shop. For the rest, you can avoid the value replacement duty in that you do not take the article like your property in use and omit everything, what impairs its value or could impair e.g. during the return. You have to bear the cost of the return, if the supplied commodity corresponds to the ordered and if the price of the article you are returning does not exceed an amount of 40 Euro or –at a higher amound- if you did not furnish at the time of the revocation the reward or a contractually arranged partial payment. Otherwise the return for you is free.
If not differently agrees, in the return exactly the mode of shipment and packing form are to be selected, which found also use with the shipment to you. Returns as "not free" or cash on delivery cannot be accepted. The burden of proof for a proper and timely return is with the buyer. If an article is not capable to be dispatched by letter or package, it will be picked up. You must fulfill obligations of payments within 30 days after sending off your revocation explanation.
FINAL REGULATIONS:
Should one of the named regulations be legally ineffectual, this has no influence on the validity of the other regulations.
